User Agreement

This User Agreement ("Agreement") is a legal agreement between you ("you" or "User") and Wavelyn ("Wavelyn," "we," "us," or "our") governing your use of the Wavelyn.top website and any related services (collectively, the "Service"). By accessing, browsing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by this Agreement, our Terms of Service, and our Privacy Policy. If you do not agree to all of the terms and conditions of this Agreement, you must not access or use the Service.
This Agreement works alongside our Terms of Service and does not replace it. Where there is a conflict between this Agreement and the Terms of Service, the Terms of Service shall prevail unless this Agreement specifically states otherwise.
1. Service Provider

2. Age Requirements
You must be at least 13 years of age (or the minimum age required to provide consent in your jurisdiction) to use the Service. If you are under 18 (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has read, understood, and agreed to this Agreement on your behalf, and that guardian is responsible for your activity on the Service.
Wavelyn does not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will take steps to delete such information promptly. If you believe a child has provided us with personal information, please contact us immediately.
3. Your Relationship with Wavelyn
3.1 What you can expect from us

If you access or use the Service on behalf of an organization or business, you represent that you are authorized to bind that organization to this Agreement. In such cases, "you" refers to both you and the organization, and the organization agrees to be responsible for its users' compliance with this Agreement.

4.4 Network connection costs

5. Prohibited Conduct
You agree not to engage in any of the following prohibited activities when using the Service:

- Scraping for competing services: Scraping, reproducing, or republishing the editorial archive as part of a competing service without our prior written permission.
- Interference: Interfering with, disrupting, or overloading the Service, its servers, or networks connected to the Service.
6. Content in Wavelyn Services
6.1 Your content
If you submit, post, or otherwise make available any content through the Service (including story tips, corrections, feedback, or other submissions — collectively "User Content"), you represent and warrant that:
- You own or have the necessary rights to submit the User Content.
- The User Content is lawful and does not violate any third-party rights.
- The User Content is accurate to the best of your knowledge.
If your User Content is protected by intellectual property rights, you grant Wavelyn a worldwide, non-exclusive, royalty-free license to host, reproduce, distribute, transmit, publicly display, modify (including reformatting or translating), and create derivative works of your User Content — solely for the purpose of operating, improving, and promoting the Service. This license remains in effect for the duration that your User Content is protected by intellectual property rights. If you request removal of your User Content, we will remove it from public display within a reasonable timeframe.
6.2 Wavelyn content
All editorial content, articles, briefings, designs, logos, graphics, page layouts, software, and other original materials published on the Service are and remain the exclusive property of Wavelyn and its licensors. You may not remove, obscure, or alter any Wavelyn branding, logos, or legal notices displayed on the Service.
You may share excerpts of our editorial content for personal, non-commercial purposes with clear attribution to Wavelyn.top and a link to the original article. Any other use requires our prior written consent.
6.3 Other content
The Service may display or link to content provided by third parties, including external image hosts and reference sources. Wavelyn does not control and assumes no responsibility for third-party content. You must not use third-party content available through the Service without the permission of its owner or as permitted by applicable law.
6.4 Feedback

EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, WAVELYN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND COURSE OF PERFORMANCE.
Wavelyn does not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that any defects will be corrected.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAVELYN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of profits, revenue, data, use, goodwill, or other intangible losses.
- Damages resulting from your access to, use of, or inability to access or use the Service.
- Any reliance on editorial or informational content published on the Service.
- Unauthorized access to or alteration of your data or transmissions.

IN ANY CASE, THE TOTAL CUMULATIVE LIABILITY OF WAVELYN FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO WAVELYN FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $50. SINCE THE SERVICE IS CURRENTLY PROVIDED FREE OF CHARGE, THIS LIMITATION MAY RESULT IN NO RECOVERABLE DAMAGES.
12. Indemnification
If you are a commercial user or organization, to the extent permitted by applicable law, you agree to defend, indemnify, and hold Wavelyn, its officers, employees, and contractors harmless from and against any and all third-party legal proceedings (including claims, losses, damages, judgments, fines, and legal expenses) arising out of or related to your unlawful use of the Service or your violation of this Agreement. This indemnification does not apply to the extent a claim is caused by Wavelyn's breach of this Agreement, negligence, or willful misconduct.
13. Taking Action in Case of Problems
If we become aware that you may have violated this Agreement, we will typically take reasonable steps to address the issue, which may include:
- Notice: We will try to provide you with notice and an explanation of the issue, and give you an opportunity to clarify or remedy it — unless doing so would cause harm, violate the law, hinder an investigation, or jeopardize the security of the Service.
- Content removal: We may remove or restrict access to content that violates this Agreement or applicable law.
- Suspension or termination: If you seriously or repeatedly violate this Agreement, or if your conduct causes harm to users, third parties, or Wavelyn, we may suspend or terminate your access to the Service.
- Legal compliance: We may take action as required by law or to comply with court orders or government requests.
14. Account Suspension and Termination
While Wavelyn is currently a read-only editorial website without user accounts, the following terms shall apply if and when account-based features are introduced:
- Voluntary deactivation: You may request deletion or deactivation of your account at any time by contacting us at [email protected].
- Termination by us: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including a breach of this Agreement.
- Survival: All provisions of this Agreement that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — shall survive any suspension or termination.
- Effect of termination: Upon termination, your right to use the Service will immediately cease. Any licenses granted to you under this Agreement will be revoked.
15. Settling Disputes, Governing Law, and Courts
15.1 Informal resolution
Before initiating formal proceedings, you agree to first contact us at [email protected] with a written description of the dispute and a proposed resolution. We will attempt to resolve the matter informally within 30 days.
15.2 Governing law
This Agreement and any dispute arising out of or relating to it shall be governed by and construed in accordance with the laws of the United States of America and, to the extent applicable, the laws of the State of Delaware, without regard to its conflict of law provisions.
15.3 Jurisdiction and courts
Subject to the informal resolution requirement above, any legal action or proceeding arising out of or related to this Agreement or the Service shall be brought exclusively in the state or federal courts located in Delaware, United States of America. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum.
15.4 Class action waiver
You and Wavelyn agree that each party may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding.
15.5 Users outside the United States
If you are accessing the Service from outside the United States, you do so at your own initiative and are responsible for compliance with applicable local laws. If local law prohibits the foregoing governing law and jurisdiction provisions, then disputes may be brought in the competent courts of your jurisdiction, and local law shall apply.
16. Changes to This Agreement
We reserve the right, at our sole discretion, to modify or replace this Agreement at any time. If material changes are made, we will try to provide at least 30 days' notice prior to the new terms taking effect by updating the "Last Updated" date on this page and, where appropriate, providing a more prominent notice on the Service.
Your continued access to or use of the Service after the revised Agreement becomes effective constitutes your acceptance of the revised terms. If you do not agree to the updated Agreement, you must stop using the Service.
A history of significant revisions will be noted below:

17. About These Terms
This Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Wavelyn regarding your use of the Service. It supersedes and replaces any prior agreements, understandings, or communications between us regarding the Service.
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
No waiver of any provision of this Agreement shall be deemed a further or continuing waiver of that provision or any other provision.

- "Service" refers to the Wavelyn.top website and any related editorial services provided by Wavelyn.
- "Wavelyn," "we," "us," or "our" refers to the owner and operator of the domain wavelyn.top.
- "You" or "User" refers to any individual or organization that accesses, browses, or uses the Service.
- "User Content" refers to any content you submit, post, or make available through the Service, including story tips, corrections, and feedback.
- "Wavelyn Content" refers to all editorial content, articles, designs, logos, graphics, software, and other original materials published on the Service.
- "Third-Party Content" refers to content, services, or websites not owned or controlled by Wavelyn but accessible through or linked from the Service.
